Why this state view

Texas added the TDPSA in 2024 — broad consumer privacy + AI profiling controls — alongside CUBI (biometric law similar to IL BIPA). Texas Bar Future of Law guidance bound lawyer AI use beginning 2024. Texas is the second-largest state economy and a leading indicator for southern-state AI regulation.

Primary frameworks anchored

  • Texas Data Privacy and Security Act (TDPSA — effective July 2024)
  • Texas Capture or Use of Biometric Identifier (CUBI)
  • Texas Bar Future of Law Committee AI Guidance (2024)
  • Texas Sunset Advisory Commission AI oversight

Buyer's guide for Texas

For Texas-deploying organizations, the binding constraint is TDPSA profiling consent + CUBI biometric handling. Vendors with strong training-opt-out defaults and granular subprocessor transparency clear the bar.

Operationalize the scoring

Methodology — TDPSA + CUBI scoring

The Index tells you which vendors clear the bar for Texas engagement. The companion resource tells you how to turn that selection into a deployable governance program with documented evidence.

Scoring as of 2026-05-13from public information (vendor trust portals, BAAs, SOC report cover pages, model cards, vendor documentation). Posture changes frequently — re-verify with the vendor's trust center before contract. State filter views surface vendors with explicit state engagement on the axes most relevant to that state's regulatory frame; they do not replace deployer-side state compliance work.
